Ukrainian Prosecutors Will Work in the Office of the Prosecutor of the International Criminal Court in Ukraine
The Cabinet of Ministers of Ukraine has approved a resolution on the signing of a draft agreement between the Government of Ukraine and the Office of the Prosecutor of the International Criminal Court (ICC) on the deployment of personnel to the ICC Office in Ukraine.
The document provides for the deployment of Ukrainian prosecutors, who will directly collect evidence and provide procedural support for investigations into international crimes committed by the aggressor country during its armed aggression against Ukraine. They will work together with ICC prosecutors to ensure the effective exchange of information, coordination of actions, and the application of best practices in international criminal justice.
The agreement defines the procedure for seconding prosecutors, guarantees their independence and establishes their legal status.
The text was developed on the basis of the ICC’s model agreement (Staff Secondment Agreement) and finalised by the Ministry of Justice in cooperation with the Office of the Prosecutor General, in consultation with ICC representatives.
The conclusion of the Agreement, provided for in Article 44 of the Rome Statute of the ICC, will ensure the permanent presence of Ukrainian prosecutors in the office of international justice on the territory of our state. This will significantly strengthen the evidence base in cases of war crimes and crimes against humanity committed by the aggressor country, contribute to the protection of the rights of victims and the establishment of the principle of the inevitability of punishment.
